Terms and Conditions for Youzzful

1. Who We Are

We are Youzzful, operating from 1309 Coffeen Avenue, STE 1200, Sheridan, WY 82801, US ("we", "us", "our" or the "Company"). We provide our services through our website and associated platforms (collectively, the "Website" or "Service").

2. Agreement Overview

By using Youzzful (the "Service"), you agree to abide by these Terms and Conditions (the "Terms" or "Agreement"). Our Privacy Policy and any specific Subscription Terms are incorporated into these Terms by reference.

Any translation of these Terms from the English version is for your convenience only. The English version, always available at terms-and-conditions.html, will prevail in case of any discrepancies.

3. Eligibility

To use Youzzful, you must be at least 16 years old and have the legal capacity to enter into an agreement. If you are under 18, you need your parent's or guardian's permission. If you do not agree with these terms or are not eligible, please do not use our Service.

4. What We Offer

Youzzful provides personalized AI learning experiences, community features, expert content, and educational tools. This may include articles, interactive tools, and community forums. All materials and services are collectively referred to as "Digital Content". You will typically need to register and select a subscription plan or introductory offer to access the full range of Digital Content and services.

5. AI-Powered Features and User Content

AI-Powered Features

While using our Service, you may interact with features powered by Artificial Intelligence. These are for informational and supportive purposes only and are not a substitute for professional advice.

User Content

You own the information you provide ("Input"). We assign you the rights we are permitted to on our generated responses ("Output"). We may use this Content to improve our services, but you can opt out by contacting us.

Nature of AI

Due to the nature of machine learning, Output may not be unique and may be similar for other users.

6. Subscription Plans

What we may offer:

• Introductory Offer: A short-term trial providing limited access to our Service. It automatically converts into a paid subscription unless canceled at least 24 hours before the trial ends. If not canceled, you will be automatically charged the full price for the subscription plan.
• Subscription Plan: An arrangement granting you ongoing access to the Service for a specified period (e.g., monthly, annually). Subscription plans automatically renew at the end of each period. You can cancel anytime at least 24 hours before the end of the current billing period in your account settings.
• Additional Paid Features: Optional functionalities offered on a subscription or one-time purchase basis.

Important Note: Some introductory offers may renew at the full, non-discounted price. Please read the terms of your selected offer carefully at the time of purchase. We reserve the right to change prices and the scope of Digital Content. We will provide reasonable notice of any price change. If you do not agree to a price change, you must cancel your subscription before it takes effect.

7. Billing and Cancellation

Methods of Payment:

• Payments are billed via Stripe, PayPal, or other designated payment providers.
• You authorize us to charge the applicable fees to your submitted payment method and to store it for automatic renewals.
• If your primary payment method fails, we may retry it or use any other stored payment method. Failed payments may result in suspension or termination of your subscription.

The period of automatic renewal:

The auto-renewal period is the same as your initial subscription period. The renewal rate will be no more than the prior period's standard rate, excluding promotions, unless we notify you of a change. You can view your next payment date in your account settings.

Cancellation and Refunds:

You must cancel your subscription according to the procedures disclosed at purchase and in our Subscription Terms. Please refer to our Subscription Terms for refund eligibility. Youzzful may also initiate cancellations and provide refunds at its sole discretion.

8. Data Protection

We collect, store, and process your data in accordance with our Privacy Policy. By using the Service, you agree to such collection, storage, and processing.

9. Use of Information and Intellectual Property

All information, text, images, graphics, marks, logos, data, and software on our Website are our property or the property of our licensors.

You are granted a non-exclusive, limited license to use the Service for personal, non-commercial purposes. You retain ownership of your "User Content," but you grant us a license to use it as reasonably required to operate the Service.

If you believe your intellectual property rights have been violated, contact us at contact@youzzful.com. We may remove allegedly infringing content and terminate repeat infringers' accounts.

Trademark: The "Youzzful" name, logos, and all related graphics are our trademarks. Use of our Service does not grant you any right to use these trademarks.

10. Third-Party Ads and Links

Our Service may contain links to third-party websites or advertisements. We are not responsible for these third parties, and you use them at your own risk. You release us from any claims related to third-party products, services, or websites.

11. Compliance

The Services are provided from the United States. If you access them from other locations, you do so at your own risk and are responsible for compliance with local laws.

12. Copyright Statement

The Youzzful product, including all materials and logos, is copyrighted. Any redistribution or reproduction of any part of the Service or Digital Content is prohibited. Any other use requires our formal written permission.

13. User Representations and Restrictions

By using the Service, you represent and warrant that you have the legal capacity, are at least 16 years old, will not use automated means to access the Service, will not use the Service for any illegal purpose, and that your use complies with all applicable laws.

You agree not to: systematically retrieve data to create a database; make derivative works from the Service; circumvent security features; engage in unauthorized framing or linking; or use the Service in a manner that is competitive with Youzzful.

14. Disclaimers of Warranties and Liabilities

• No Guarantees: We make no guarantees that the Digital Content will meet your needs or that you will achieve any specific results. Your results will vary based on personal commitment and circumstances.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YOUZZFUL (OR ITS AFFILIATES) BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS IS LIMITED TO THE AMOUNTS YOU HAVE ACTUALLY PAID TO YOUZZFUL FOR THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify and hold Youzzful, its officers, directors, employees, and agents harmless from any claims, damages, or losses arising from your use of the Service, your User Content, or your violation of these Terms.

17. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@youzzful.com with a detailed description of the dispute.

Agreement to Arbitrate

You and Youzzful agree to resolve any disputes through final and binding arbitration on an individual basis, except you can sue in small claims court or to seek injunctive relief for intellectual property infringement.

No Class Actions

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class or representative action.

Opt-Out

You can opt out of this arbitration agreement within 30 days of first using the Service by sending a written opt-out notice to contact@youzzful.com with your name, account email, and a clear statement of your wish to opt out.

Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any legal suit or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Sheridan County, Wyoming.

18. Miscellaneous

We may modify or discontinue the Service at any time. We are not liable for any delay or failure caused by circumstances beyond our reasonable control.

19. Changes to Terms

We may update these Terms. We will provide at least 30 days' notice for material adverse changes. Your continued use of the Service after the effective date of changes constitutes your acceptance of them. If you object to a material change, you may terminate your account within the 30-day notice period.
